These Terms of Service govern your use of macsapparels.com and every purchase you make from Macsapparels (Macs Apparels & Accessories), an online discounted clothing and accessories store based in Atlanta, Georgia. Please read them carefully: they explain your rights, our responsibilities, and important limits, including our all sales final policy and how disputes are resolved.

Acceptance of These Terms and Eligibility

Agreement to the terms

By accessing or using the website located at https://macsapparels.com (the "Site"), creating an account, or placing an order, you agree to be bound by these Terms of Service (the "Terms") and by the policies referenced in them, including our Privacy Policy, Shipping Policy, Refund & Returns Policy, and Cookie Policy. In these Terms, "Macsapparels," "we," "us," and "our" refer to the business operating the Site, and "you" and "your" refer to any person who visits the Site or buys from us. If you do not agree to these Terms, please do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority in your state or country of residence, to place an order. If you are younger, you may use the Site only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Site, you confirm that you meet these requirements and that the information you provide to us is true, accurate, and complete. We may refuse service to anyone, at any time, for any lawful reason.

Your Account

You can browse and buy without an account, but creating one lets you view order history and take part in Mac's Rewards. If you create an account, you agree to:

  • Provide accurate, current information and keep it up to date
  • Keep your password confidential and not share your account with others
  • Notify us promptly at [email protected] if you suspect unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We may suspend or close accounts that provide false information, abuse promotions, violate these Terms, or are involved in fraudulent activity. You may close your account at any time by contacting us.

Products, Pricing, and Errors

Product information

We try to describe every product as accurately as possible, including its materials, measurements, and care instructions. Many of our bags are made from faux leather, and much of our jewelry is antique silver, silver-plated, or stainless steel; product pages note the material where it is known. We do not warrant that product descriptions or other content on the Site are complete, error-free, or current.

Colors and sizing

Product colors may look different on your screen than in person because of monitor settings, lighting in photography, and natural variation between production batches. Sizing also varies between brands and styles. Please review the measurements on each product page and consult our Size Guide before ordering. Because all sales are final, differences in color perception or fit are not considered a defect and are not grounds for a refund or exchange.

Pricing and availability

All prices are shown in US dollars and may change at any time without notice. Prices do not include shipping, applicable sales tax, or, for international orders, customs duties and import taxes. Products are available while supplies last, and we may limit quantities or discontinue items at any time.

Errors and inaccuracies

Occasionally the Site may contain typographical errors, pricing mistakes, or inaccurate availability information. We reserve the right to correct any error, and to cancel or refuse any order affected by an error, even after you have submitted it and received a confirmation. If we cancel an order you have already paid for, we will refund the full amount to your original payment method.

Orders, Acceptance, and Payment

How orders are formed

Your order is an offer to buy the products in your cart. When you submit an order, our system generates an order number and sends you an order confirmation email. That confirmation means we have received your order; it does not mean we have accepted it. We accept your order when we ship it, at which point a binding contract of sale is formed and a tracking number is provided.

Our right to refuse or cancel

We may refuse or cancel any order, or limit quantities per person, household, or order, including where we suspect fraud, reselling, an unauthorized payment, a pricing error, or a violation of these Terms. If we cancel an order after payment, we will refund you in full.

Your cancellations

You may cancel an order only before it ships. Contact us as soon as possible by phone or email. Once an order has shipped, it cannot be cancelled.

Payment

We accept the payment methods shown at checkout. By submitting payment information, you confirm that you are authorized to use the payment method and you authorize us and our payment processors to charge the full order amount, including shipping and taxes. Payments are processed by third-party payment providers; we do not store your full card number. If a payment is declined or reversed, we may cancel the order.

Sales tax

We collect sales tax where required by law, based on your shipping address. The amount is shown at checkout before you place your order.

Shipping, Title, Risk of Loss, and Returns

Shipping

We ship through various carriers using the methods described in our Shipping Policy, including Ground, 2-Day Air, Overnight, regular mail, and international shipping. Domestic Ground shipping is free on orders over $299. Delivery dates are estimates and are not guaranteed.

Title and risk of loss

Title to products passes to you when we deliver them to the carrier. Risk of loss passes to you upon delivery to the shipping address you provided. Even so, if a package is lost in transit or arrives damaged and you report it within 3 days of delivery, we will help you under our 100% Moneyback Guarantee.

Returns and refunds

All sales are final. We do not offer refunds or exchanges on merchandise, except for items that arrive wrong, damaged, or defective, or that are not delivered, and that are reported to us within 3 days of delivery. In those cases we will arrange a replacement or a refund. Full details are in our Refund & Returns Policy, which forms part of these Terms.

Promotions, Mac's Rewards, and Mac's Referral

Promotions and discount codes

  • Discount codes and promotions are valid only during the stated period and subject to any stated conditions.
  • Unless stated otherwise, only one code may be used per order, codes cannot be combined, and they have no cash value.
  • Codes cannot be applied to previous orders, shipping charges, taxes, or duties unless the offer says so.
  • We may end or change any promotion at any time and may cancel orders that use codes obtained or used improperly.

Mac's Rewards

Mac's Rewards is our loyalty program. Members may earn points or rewards on eligible purchases as described on our Site at the time of purchase. Rewards have no cash value, are not transferable, cannot be sold or exchanged, and may expire as stated in the program details. Points earned on an order may be removed if the order is cancelled or refunded. We may change, suspend, or end Mac's Rewards, including earning and redemption rates, at any time, and will provide notice on the Site where reasonably possible.

Mac's Referral

Mac's Referral lets you invite friends to shop with us. Referral rewards are issued only when a genuinely new customer places a qualifying order using your referral link or code. You may not refer yourself, create multiple accounts, post referral codes on coupon or deal websites, or use spam or misleading messages to share them. We may withhold or reverse referral rewards that we reasonably believe were earned in violation of these rules.

User Content and Reviews

You may be able to submit product reviews, ratings, photos, questions, and other content ("User Content"). By submitting User Content, you:

  • Confirm that it is your own, is truthful, reflects your genuine experience, and does not infringe anyone else's rights
  • Grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, edit for length and clarity, and distribute it in connection with the Site and our marketing
  • Agree not to post anything unlawful, defamatory, obscene, hateful, harassing, misleading, or that contains personal information about others
  • Agree not to post reviews in exchange for undisclosed payment or free products

We do not pay for positive reviews, and we do not remove reviews simply because they are negative. We may, however, decline to publish or remove any User Content that violates these Terms or that we reasonably consider inappropriate.

Intellectual Property

All content on the Site, including text, graphics, logos, product photography, page layouts, blog articles, and the "Macsapparels" and "Macs Apparels & Accessories" names, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to access and use the Site for your personal, non-commercial shopping. You may not copy, reproduce, republish, scrape, modify, or sell any part of the Site without our prior written permission. Brand names of products we sell belong to their respective owners.

Prohibited Uses and Third-Party Links

Prohibited uses

You agree not to use the Site to:

  • Break any law or regulation, or encourage others to do so
  • Place fraudulent orders or use payment methods you are not authorized to use
  • Buy products for commercial resale without our written consent
  • Upload or transmit viruses, malware, or other harmful code
  • Use bots, scrapers, or automated tools to access, copy, or monitor the Site
  • Interfere with the security or operation of the Site or attempt to gain unauthorized access to it
  • Harass, abuse, or harm our staff or other customers
  • Impersonate any person or misrepresent your affiliation with anyone
  • Abuse promotions, rewards, or the referral program

We may suspend or terminate your access to the Site and cancel orders if you violate these rules.

Third-party links

The Site may contain links to third-party websites, such as shipping carrier tracking pages or payment providers. We do not control and are not responsible for the content, policies, or practices of those sites. Your use of third-party websites is at your own risk and subject to their terms.

Disclaimers

Except as expressly stated in these Terms and our Refund & Returns Policy, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that products will meet your expectations.

Style advice, size guidance, and blog content are provided for general information only. Cosmetics, perfumes, and colognes may cause reactions in some people; please review ingredients and perform a patch test before full use. Some jewelry may contain metals that can irritate sensitive skin. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

Limitation of Liability and Indemnification

Limitation of liability

To the fullest extent permitted by law, Macsapparels and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Site or any product, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Our total liability for any other claim relating to the Site will not exceed one hundred US dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Macsapparels and its owners, employees, and service providers from any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your User Content, your misuse of the Site, or your violation of any law or the rights of a third party.

Governing Law and Dispute Resolution

Governing law

These Terms and any dispute arising out of or relating to them, the Site, or your purchases are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.

Informal resolution first

Most concerns can be solved quickly. Before starting any formal proceeding, you agree to contact us at [email protected] or 404-702-6379 and describe the issue and the remedy you want. We will both try in good faith to resolve the dispute informally within 30 days.

Venue

If a dispute is not resolved informally, you and we agree that it will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and both parties consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small claims court if it qualifies. To the extent permitted by law, claims must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.

Consumer rights

Nothing in this section removes any consumer protection rights you may have under the mandatory laws of the place where you live.

Severability, Changes, and General Terms

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the "Last updated" date above. The Terms in effect at the time you place an order apply to that order. Your continued use of the Site after changes are posted means you accept the updated Terms.

Entire agreement and waiver

These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Site and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
